
This Agreement sets forth the terms and conditions (the "Terms") that govern your use of this Crystal Mountain’s internet service (the “Service”). Crystal Mountain may revise this Agreement at any time. You must review and accept this Agreement each time you access the internet. If you do not agree with these Terms, do not use the Service.
By using the internet services, you agree that the laws of the State of Michigan and Michigan jurisdiction govern any and all disputes, allegations, claims, actions, and demands in any way related to the provision of the internet services.
Disclaimers
Crystal Mountain provides public access to the internet. There are potentially serious security issues with any computer connected to the internet without the appropriate protection. This can be true of connections made through a wireless network, ethernet connection, a cable modem, dial-up access or otherwise. These security issues range from viruses, worms, malware, ransomware and other programs that can damage the user's computer to attacks on the computer by unauthorized or unwanted third parties. These parties, known commonly as "hackers" may attempt to penetrate the user's computer and download information from the user's computer. If the user has unprotected files on the computer, these files may be visible to hackers on the internet, potentially including parties with criminal intent. Hackers also exploit vulnerabilities in operating systems to cause malicious damage to a user's computer or even a whole company's network, up to and including the destruction or deletion of files, the copying or stealing of personal or financial information or the reformatting of drives. It is recommended that the user use either a personal firewall or Virtual Private Network systems to protect this information. Crystal Mountain advises the user that he/she should consult a security expert to determine whether there are any potential security holes in their computer's configuration.
It is acknowledged by the user that Crystal Mountain does not have security measures in place to protect against the loss, misuse, or alteration of the information. The security of your data and use of the internet and Crystal Mountain’s network is your responsibility. We encourage you to take whatever measures you deem appropriate to secure your data while using the service. Nothing in the Crystal Mountain system will thwart built-in security of other sites.
EACH OF CRYSTAL MOUNTAIN , THE OWNER IT'S AGENTS, SERVANTS, EMPLOYEES, DIRECTORS OFFICERS AND SHAREHOLDERS OF THE VENUE AT WHICH THE INTERNET IS ACCESSED SPECIFICALLY DISCLAIMS ANY LIABILITY FOR UNAUTHORIZED THIRDPARTY SECURITY BREACHES OR THE RESULTS THEREOF. UNLESS OTHERWISE EXPLICITY STATED, THE INTERNET SERVICE IS PROVIDED "AS IS" AND ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT, ARE DISCLAIMED, EXCEPT TO THE EXTENT THAT SUCH DISCLAIMERS ARE HELD TO BE LEGALLY INVALID. CRYSTALMOUNTAIN MAKES NO REPRESENTATIONS, WARRANTIES OR GUARANTIES AS TO THE QUALITY, SUITABILITY, TRUTH, ACCURACY OR COMPLETENESS OF ANY OF THE MATERIALS PRESENTED WITH USE OF THE INTERNET SERVICE. ANY QUESTIONS REGARDING THE MATERIALS SHOULD BE DIRECTED TO THE PROVIDERS OF SUCH MATERIALS.
Limitation of Liability
By using the internet service you expressly acknowledge and agree that there are significant security and privacy risks inherent in accessing or transmitting information through the internet. These issues include, but are not limited to, the interception of transmissions, loss of data, access to your data by hackers and the introduction of viruses, malware or ransomware to your computer or other electronic device(s).
ACCORDINGLY, YOU AGREE THAT CRYSTAL MOUNTAIN, ITS EMPLOYEES, AGENTS AND OWNERS SHALL NOT BE LIABLE FOR ANY INTERCEPTION OR TRANSMISSIONS, LOSS OF DATA, FILE CORRUPTION, THEFT OF PERSONAL IDENTIFIABLE OR FINANCIAL INFORMATION, HACKING OR DAMAGE TO YOUR COMPUTER OR OTHER DEVICE OR FOR ANY DAMAGES SUFFERED, OR CLAIMED TO BE SUFFERED, AS A RESULT OF YOUR USE OF THE INTERNET SERVICE EVEN IF CRYSTAL MOUNTAIN HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. YOU HAVE SOLE RESPONSIBILITY FOR ADEQUATE PROTECTION AND BACKUP OF DATA AND/OR EQUIPMENT USED IN CONNECTION WITH THE INTERNET SERVICE. ADDITIONALLY, YOU AGREE TO HOLD HARMLESS AND INDEMNIFY CRYSTALMOUNTAIN, ITS AGENTS, EMPLOYEES AND OWNERS FROM ANY AND ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE INTERNET SERVICE.
Crystal Mountain Acceptable Use Policy
All users of Crystal Mountain’s Internet services (the "Services") agree to and must comply with this Acceptable Use Policy (AUP). Violation of this AUP may result in the suspension or termination of either access to the Services and/or Crystal Mountain account or other actions as detailed below. Crystal Mountain does not exercise editorial control or review over the content of any web site, electronic mail transmission, streaming, newsgroup, or other material created or accessible over or through the Services. However, Crystal Mountain may remove, block, filter, or restrict by any other means any materials that, in Crystal Mountain's sole discretion, may be illegal, may subject Crystal Mountain to liability, or which may violate this AUP. Crystal Mountain may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong.
The following constitute violations of this AUP (this list is intended to be illustrative and not exhaustive; other uses may violate the AUP and Crystal Mountain remains the sole and final arbiter of acceptable usage of its Services):
Illegal use: Using the Services to transmit any material (by email, uploading, posting, or otherwise) that, intentionally or unintentionally, violates any applicable local, state, national or international law, or any rules, copywrites or regulations promulgated thereunder.
Harm to minors: Using the Services to harm, or attempt to harm, minors in any way.
Threats/harassment: Using the Services to transmit any material (by email, uploading, posting, or otherwise) that threatens, harasses, or encourages bodily harm or destruction of property.
Fraudulent activity: Using the Services to make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as "pyramid schemes," "Ponzi schemes", unregistered sales of securities, securities fraud and "chain letters."
Forgery or impersonation: Adding, removing or modifying identifying network, message, or article header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.
Spamming/unsolicited commercial email/unsolicited bulk email: Using the Services to transmit any unsolicited commercial email or unsolicited bulk email. Activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email, whether or not that email is commercial in nature, are prohibited. Using deliberately misleading headers in emails sent to multiple parties is prohibited.
Unauthorized access: Using the Services to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Crystal Mountain's or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in disruption of service or the corruption or loss of data.
Copyright or trademark infringement: Using the Services to transmit any material (by email, uploading, posting, or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party.
Collection of personal data: Using the Services to collect, or attempt to collect, personal information about third parties without their knowledge or consent.
Reselling the services: Reselling the Services without Crystal Mountain's authorization.
Network disruptions and unfriendly activity: Using the Services for any activity which adversely affects the ability of other people or systems to use Crystal Mountain Services or the Internet. This includes excessive consumption of network or system resources whether intentional or unintentional. This also includes "denial of service" (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, network services or network equipment is prohibited. It is the users’ responsibility to ensure that their system is configured, operated, and used in a manner to avoid excessive consumption of network or system resources. It is the users’ responsibility to ensure that their system is configured in a secure manner. A user may not, through action or inaction, allow others to use their system for illegal or inappropriate actions. A user may not permit their system, through action or inaction, to be configured in such a way that gives a third party the capability to use their system in an illegal or inappropriate manner.
News: Crystal Mountain users should use their best judgment when posting to any newsgroup. Many newsgroups have charters, published guidelines, FAQs, or "community standards" describing what is and is not considered appropriate. USENET can be a valuable resource if used properly. Please be familiar with basic USENET "netiquette" before posting to a newsgroup.
High Volume, Server Hosting, and nontraditional end user activities: The Services are intended for an end user's periodic active use of email, instant messaging, browsing the World Wide Web, and other typical end user activities. High volume data transfers, especially sustained high volume data transfers, are prohibited. Hosting a web server, IRC server, or any other server is prohibited. Accordingly, Crystal Mountain maintains the right to terminate any user's connection following the detection of any high volume data transfer, server hosting, or nontraditional end user activity as determined by Crystal Mountain.
Crystal Mountain reserves the right to revise, amend, or modify this AUP, and our other policies and agreements at any time and in any manner.
Crystal Mountain Privacy Policy
Crystal Mountain Cares about Protecting the Privacy of Your Family. We at Crystal Mountain are concerned about the safety of minor children when they use the Internet. We want you and your family to be safe while using the Crystal Mountain network. That's why we have established the following guidelines for the way we interact with children when they access our services. Consistent with the Federal Children's Online Privacy Protection Act of 1998 (COPPA), we will never knowingly request personally identifiable information from anyone under the age of 13 without requesting parental consent. Furthermore, children as a rule cannot gain access to the Crystal Mountain network unless their parent or guardian has given verbal consent.
