Flexpay is a buy now, pay later payment option offered through Uplift, Inc. (“Uplift”), a third-party lender. Crystal Mountain is not a party to your financing arrangement with Uplift and expressly disclaims all responsibility and liability relating to or arising in any way from your relationship with Uplift. Your Responsibility Code
I am familiar with and will adhere to “YOUR RESPONSIBILITY CODE”:
1. Always stay in control. You must be able to stop or avoid people or objects.
2. People ahead or downhill of you have the right-of-way. You must avoid them.
3. Stop only where you are visible from above and do not restrict traffic.
4. Look uphill and avoid others before starting downhill or entering a trail.
5. You must prevent runaway equipment.
6. Read and obey all signs, warnings, and hazard markings.
7. Keep off closed trails and out of closed areas.
8. You must know how and be able to load, ride and unload lifts safely. If you need assistance, ask the lift attendant.
9. Do not use lifts or terrain when impaired by alcohol or drugs.
10. If you are involved in a collision or incident, share your contact information with each other and a ski area employee.
Winter sports involve risk of serious injury or death. Your knowledge, decisions, and actions contribute to your safety and that of others. If you need help understanding the Code, please ask Crystal Mountain management for additional help.

This is a partial list. Be safety conscious.
I am aware that skiing, snowboarding, race events and related activities are HAZARDOUS and involve many RISKS and DANGERS including, but not limited to: boarding, riding and disembarking ski lifts; falls from lifts or from evacuation equipment, encounters with on-going snow making and grooming; changing weather conditions; contact with exposed rock, earth, ice and other natural objects including but not limited to trees, tree stumps, and forest dead fall; snow or ice on or beneath the skiing surface; changes or variations in the skiing terrain which may create blind spots or areas of reduced visibility; changes or variations in the skiing surface or subsurface, including changes due to man-made or artificial snow, variable and difficult snow conditions; slick walking surfaces including, but not limited to sidewalks and parking lots, the presence of streams, creeks and exposed holes in the snow pack; snowcat roads, road-banks or cut-banks; impact or collision with lift towers, trees, manmade features, pipes, rails, jumps, fences, ropes, buildings, posts, boundary markers, snow making equipment, snow grooming equipment, snowmobiles or other vehicles, equipment or structures; impact or collision with other skiers; negligence of other skiers and; negligence on the part of Crystal Mountain, its employees, owners, officers, representatives, directors, shareholders, agents, and vendors. I am aware that the RISKS, DANGERS and HAZARDS referenced above exist throughout the Resort and that many risks, dangers and hazards are unmarked.
Be advised that all fencing, pads, poles, signage and other marking devices are in place to inform you and to indicate a potential obstacle or hazard. THESE MARKERS WILL NOT PROTECT YOU FROM INJURY. It is your responsibility to stay away from marked objects and areas.
I and/or the minor agree to conduct ourselves within the limits of my individual ability while at Crystal Mountain and agree not to act, ski or snowboard in a manner that might contribute to injuries. I and/or the minor understand that I and/or the minor are the sole judge of our ability to negotiate a track, trail or slope. The Holder understands that he/she is solely responsible for reading and understanding all signage and instructions on the premises and for complying with them. In consideration of Crystal Mountain accepting me and or the minor as a Season Pass Holder and permitting me and or the minor to use Crystal Mountain's ski lifts, parking and other facilities, and to participate in races and special events, I INDIVIDUALLY AND AS PARENT/GUARDIAN OF THE MINOR HEREBY EXPRESSLY ASSUME AND ACCEPT ANY AND ALL RISKS AND DANGERS ASSOCIATED WITH MY PARTICIPATION IN SKIING, SNOWBOARDING OR OTHER ACTIVITIES AT CRYSTAL MOUNTAIN, INCLUDING BUT NOT LIMITED TO THE POSSIBILITY OF PERSONAL INJURIES, DEATH AND PROPERTY DAMAGE. IN FURTHER CONSIDERATION OF USING THIS PASS AND THE CRYSTAL MOUNTAIN FACILITIES THE PURCHASER AND USER OF THE PASS AGREES NOT TO SUE CRYSTAL MOUNTAIN, ITS EMPLOYEES, OWNERS, OFFICERS, REPRESENTATIVES, DIRECTORS, SHAREHOLDERS, AGENTS AND VENDORS (“COLLECTIVELY “CRYSTAL MOUNTAIN RESORT”).
Passes/Cards/Tickets
The pass/card being issued is valid for the current season only, remains the property of Crystal Mountain and may be revoked or terminated on the breach of any of the provisions of this agreement. I understand that fraudulent use of this pass/card by me and/or others, or misrepresentation of my status making me ineligible for the pass/card I have applied for, will result in criminal prosecution, and is grounds for terminating and revoking the pass/card without refund. Crystal Mountain reserves the right to require identification at any time.
Passes/cards/tickets are non-assignable and non-transferable. I will not allow any other person to use the pass/card at any time. If I do so, I understand and agree Crystal Mountain can revoke and terminate the pass/card without refund. Any unused visits/validations are considered forfeited. I agree that lift tickets may not be resold.
In the event the pass/card is lost, stolen, broken or rendered unrecognizable, I will immediately notify Crystal Mountain I agree to pay $50 for a replacement of my Season Pass and $5 per ticket.
I understand and agree that any number of conditions, natural or otherwise, may prevent Crystal Mountain from offering full use of all equipment and facilities. Crystal Mountain does not warrant or guarantee that all of its lifts, terrain or other facilities will be open or available to the public. No refunds, partial or complete, will be provided if any lifts, terrain or other facilities, which I may desire to use, are not open or available. I understand that the purchase of a pass/card/lift ticket does not guarantee availability of rental equipment or lessons.
Ski/Snowboard Rental
If renting equipment, I understand and agree that the sports of skiing, snowboarding, ski boarding, snowshoeing and other snow sports (collectively “RECREATIONAL SNOW SPORTS”) involve risks of INJURY and DEATH. I voluntarily agree to expressly assume all risk of injury or death that may result from participation in RECREATIONAL SNOW SPORTS or which relate in any way to the use of this rental equipment.
To the fullest extent allowed by law, I hereby agree to forever release and hold harmless Crystal Mountain and all manufacturers and distributors of this equipment, as well as their owners, agents, employees and affiliated companies, from any and all responsibility or legal liability for any injuries, damages or death to any user of any equipment listed on this form, whether resulting from negligence or any other cause.
I further understand that a helmet designated for RECREATIONS SNOW SPORTS use may help reduce the risk of some types of injuries at slower speeds. I recognize that serious injury or death can result from low and high energy impacts, even when a helmet is worn. I understand that helmets do not protect against trauma to the face, neck and spine and that these features are inherent risks of using this rental equipment. I understand that to function at its full capacity the helmet must fit correctly and I agree that the helmet provided properly fits me or the minor(s).
I further accept for use AS IS the equipment listed on this form without any warranties other than those stated in the agreement. I agree that I accept full financial responsibility for the care of the equipment while it is in my possession. I also agree that I will be responsible for the replacement at full value of any equipment rented buy not returned to the rental shop. I agree to return all rental equipment by the agreed date and time.
For Alpine Ski Equipment, I understand that the ski-boot-binding system is designed to release the boot from the ski when certain forces on the system reach preset values, but that the binding will not release or retain at all times where release or retention may prevent injury, and that it cannot prevent all injuries to any part the user’s body. I understand and agree that lower settings on my bindings will increase releasability but also increase the risk of injury due to inadvertent release, the higher settings on my bindings will increase retention but also increase the risk of injury due to non-release, and that injuries due to unwanted release or retention are inherent risks of skiing. For Snowboards, Skiboards, and Nordic Equipment, I understand that these systems function differently from Alpine ski bindings in that snowboard, skiboard, and Nordic bindings will not release in falls or accidents. I understand and agree that these systems do not protect against any type of injury and that any injuries resulting from these circumstances are inherent risks of the sport. I agree that these features as to particular bindings are inherent risks of RECREATIONAL SNOW SPORTS.
ADULT/PARENT/GUARDIAN: In consideration of Crystal Mountain allowing me and/or the Minor(s) identified above (if applicable) to use the listed equipment and Crystal Mountain’s ski lifts, slopes, terrain parks, restaurants, parking and other facilities, I agree to Release, Hold Harmless, Indemnify, Defend and AGREE NOT TO SUE Crystal Mountain, the Manufacturers and Distributors of the equipment and their agents and employees (collectively – PROVIDERS) from any and all claims of actions including claims or actions brought by the Minor or myself, including, but not limited to, negligence, negligence of Providers, breach of any statutory or other duty of care. I further agree to Indemnify, Hold Harmless and Defend Providers from any damage costs or expenses, including actual attorney fees and costs, without limitation, which Providers sustain as a result of my and/or the Minor’s use of the above listed equipment.
I agree not to allow the equipment to be used by any other person other than the user designated in this agreement. In the event that the equipment is used by another person, I certify that I am signing as agent or legal guardian for the user. I agree to provide this form and all warnings and information to the user, and I agree to Release and Agree to Hold Harmless, Indemnify and Defend Providers from any claims, demands or damages resulting from or related to the use of the equipment by another person. In the event of an accident while using the equipment or damage otherwise inflicted on the helmet, I agree to immediately cease use, return equipment to the rental facility and provide a written report detailing the incident.
Lessons
I am aware that skiing and snowboarding involves many RISKS, DANGERS and HAZARDS, including, but not limited to: boarding, riding and disembarking ski lifts; changing weather conditions; exposed rock, earth, ice and other natural objects including but not limited to trees, tree stumps, and forest dead fall; the condition of snow or ice on or beneath the skiing surface; changes or variations in the skiing terrain which may create blind spots or areas of reduced visibility; changes or variations in the skiing surface or subsurface, including changes due to man-made or artificial snow, variable and difficult snow conditions; slick walking surfaces including, but not limited to sidewalks and parking lots, streams, creeks and exposed holes in the snow pack above streams or creeks; snowcat roads, road-banks or cut-banks; impact or collision with lift towers, manmade features, trees, pipes, rails, jumps, fences, snow making equipment, snow grooming equipment, snowcats, snowmobiles or other vehicles, equipment or structures; impact or collision with other skiers; the failure to ski safely or within one's own ability or within designated areas; negligence of other skiers and; negligence on the part of Crystal Mountain, its employees, owners, officers, representatives, directors, shareholders, agents, and vendors. I am also aware that the RISKS, DANGERS and HAZARDS referred to above exist throughout the ski area and that many risks, dangers and hazards are unmarked. In consideration of Crystal Mountain accepting my and/or the minor's participation in the Snow Sports School, School Programs, Race, Super-Cross, or Special event program, and being permitted to use Crystal Mountain ski lifts, slopes, terrain parks, restaurants, parking and/or other facilities, INDIVIDUALLY AND AS PARENT/GUARDIAN OF THE MINOR I HEREBY EXPRESSLY ASSUME AND ACCEPT ANY AND ALL RISKS AND DANGERS ASSOCIATED WITH MY AND/OR THE MINOR'S PARTICIPATION IN THE SNOW SPORTS SCHOOL, SCHOOL PROGRAMS, RACE, SUPER-CROSS, SPECIAL EVENT PROGRAM, OR USE OF CRYSTAL MOUNTAIN SKI LIFTS, SLOPES, TERRAIN PARKS, RESTAURANTS, PARKING AND/OR OTHER FACILTIIES, INCLUDING BUT NOT LIMITED TO THE POSSIBILITY OF SERIOUS PERSONAL INJURIES, DEATH AND PROPERTY DAMAGE AND AGREES NOT TO SUE CRYSTAL MOUNTAIN, ITS EMPLOYEES, OWNERS, OFFICERS, REPRESENTATIVES, DIRECTORS, SHAREHOLDERS, AGENTS AND VENDORS (“COLLECTIVELY “CRYSTAL MOUNTAIN RESORT”)
ADULT/PARENT/GUARDIAN: In consideration of Crystal Mountain allowing me or the minor (if applicable) to participate in the Snow Sports School, School Programs, Super-Cross, or Special event program, and being permitted to use Crystal Mountain ski lifts, slopes, terrain parks, restaurants, parking and/or other facilities. I agree to Release, Hold Harmless, Indemnify and Defend Crystal Mountain, its employees, owners, officers, representatives, directors, shareholders, agents and vendors (collectively “Crystal Mountain Resort”) from any and all claims, actions, losses, suits, damages, and allegations, including claims or actions brought by the minor and claims related to or arising from incidents that occurred prior to, on and/or following the date of this release, including, but not limited to: allegations of negligence, including the negligence of Crystal Mountain Resort, breach of contract, breach of any statutory or other duty of care and breach of express or implied warranty. I further agree to Indemnify, Hold Harmless and Defend Crystal Mountain Resort from any damage, costs or expenses, including actual attorney fees and costs, without limitation, which Crystal Mountain Resort may sustain in relation to or arising out of my and/or the minor’s participation in the Snow Sports School, School Programs, Race, Super-Cross, Special event program, and/or use of the ski lifts, slopes, terrain parks, restaurants, parking or other facilities.
Safety
Ski, Snowboard, and tube at your own risk. Crystal Mountain is not responsible for accidents. All signs, rules, policies that refer to skiing also apply to snowboarding. Be aware of changing conditions. Natural and manmade obstacles exist. Snowmaking and grooming activities are routinely in progress on slopes and trails. Use caution, ski/snowboard in control and only on designated slopes or trails. Any number of conditions, natural or otherwise, may prevent Crystal Mountain from offering full use of all equipment and facilities at the area. Crystal Mountain does not warrant or guarantee that all of its lifts, terrain or other facilities will be open or available to the public. Snow is our business. We make every effort to make snow during the evening when closed; however, in order to provide sufficient coverage, it may be necessary to make snow during operating hours. Trails may be closed for various reasons such as lack of snow, snowmaking in progress, racing events, grooming, etc. No refunds, partial or complete, will be provided if any lifts, terrain or other facilities are not open or available.
Lift Tickets
Access to the snow is permitted only to those with a valid RFID Lift Ticket. Anyone caught on the snow without a valid ticket will be charged double. The purchase of a Lift Ticket does not guarantee the availability of rental equipment or lessons. Lost RFID cards are subject to a $5 reprint fee.
Rental Equipment
Anyone using rental equipment without a valid paid rental will be charged double. Broken or unreturned equipment charges will be made to responsible patron. Do not make adjustments to your ski bindings. Always return to rental area for any exchanges or adjustments which should be made by Rental Shop personnel. Check rental ID number each time you put on your rental equipment and make sure it matches your rental form. Always check to make sure your equipment functions properly. Skis, Snowboards and Blades must have metal edges. We recommend that equipment not be brought into the lodge.
Activities
I am aware that SNOWBOARDING, SKIING, RUNNING, HIKING, FITNESS CLASSES, CAMPFIRES, ICE SKATING, ICE SKATING LESSONS, ARCHERY, ARCHERY TAG, LASER TAG, ADVENTURE COURSE AND ZIP LINE, CLIMBING WALL, ALPINE SLIDE, SWIMMING, FISHING, BOATING, LAWN GAMES, FAMILY ADVENTURE PROGRAMS, CHILDREN’S PROGRAMS, BIKING, INCLUDING MOUNTAIN, CROSS COUNTRY, DOWNHILL, AND FAT TIRE, SNOWSHOEING, ON-HILL SNOWSHOEING AND BIKING, PLAYING DISC GOLF, SCAVENGER HUNTS, RIDING IN RESORT SHUTTLES, LOADING, UNLOADING, AND RIDING THE CHAIRLIFT, LIFT ASSISTED BIKING, AND SPECIAL EVENTS INCLUDING WAGON RIDES, SURREY RIDES, POOL GAMES, CRAZY OLYMPICS, CARNIVAL GAMES, PETTING ZOO, PUMPKIN CARVING, INFLATABLES, INLINE ROLLER SKATING/SKIING, OBSTACLE COURSE, BOUNCE HOUSE, FOURTH OF JULY RUN, BIGGEST LITTLE RACE, TURKEY VULTURE TROT, FAT CHANCE BIKE RACE, PEAK2PEAK KIDS BIKE RACES, PAINTBALL BIATHLON, CARDBOARD CLASSIC, SLUSH CUP, KAYAKS ON THE SNOW, EASTER EGG HUNT, X4 AUTO BUNGEE, PRESENT MANY RISKS, DANGERS and HAZARDS, including, but not limited to: falls, bike rentals, bike riding; bumps, bruises, brain damage, changing weather conditions and/or changes or variations in the terrain which may create challenging conditions, blind spots or areas of reduced visibility; changes or variations in the surface or subsurface, impact or collision with natural or man-made objects, other participants; negligence of other participants and negligence on the part of Crystal Mountain, its employees, owners, officers, representatives, directors, shareholders, agents, and vendors, of which may result in severe and occasionally fatal injury. I am also aware that the RISKS, DANGERS and HAZARDS referred to above exist throughout the Resort area and that many are unmarked.
In consideration of Crystal Mountain allowing me and/or the minor to participate in the activities and use the Crystal Mountain equipment on Crystal Mountain's property, I HEREBY EXPRESSLY ACCEPT RISKS AND DANGERS ASSOCIATED WITH MY AND/OR THE MINOR'S PARTICIPATION IN THE ACTIVITIES AND USE OF THE EQUIPMENT INCLUDING BUT NOT LIMITED TO THE POSSIBILITY OF SERIOUS PERSONAL INJURIES, DEATH AND PROPERTY DAMAGE AND AGREES NOT TO SUE CRYSTAL MOUNTAIN , ITS EMPLOYEES, OWNERS, OFFICERS, REPRESENTATIVES, DIRECTORS, SHAREHOLDERS, AGENTS AND VENDORS.. I understand that I am solely responsible for loss or damages, including death, that I and/or the minor sustains while using the equipment and/or participating in the activities and that by this agreement, I am relieving Crystal Mountain of liability for such loss, damage or death. I hereby waive claims I may have because of injury to my person or property because of my and/or the minor's use of Crystal Mountain's equipment, participation in activities and/or in other activities in which I and/or the minor may voluntarily participate.
Crystal Mountain strongly recommends the use of a helmet and protective equipment for participation in biking. I have been advised that this equipment is available for my use at no additional charge.
Miscellaneous
Don’t be a victim of theft! Lock up skis/snowboards and your personal items. Crystal Mountain is not responsible for lost or stolen items. You are responsible for your possessions while you are visiting our resort. Skis and snowboards are prohibited inside the lodge and should be secured on the outdoor racks with personal equipment locks or dropped off at our Free Ski/Board Check located in the Rental Shop.
Sleds not permitted on snow. No rainchecks. All lodges are smoke free. Weapons of any kind are not permitted on the premises. Pets not permitted in the lodges or on the snow. Under certain conditions, a grease-like substance may drip from mechanical equipment on chairlifts. Crystal Mountain is not responsible for grease on clothing. Photographs/video taken may be used for advertising for Crystal Mountain Management reserves the right to publish these photos and no compensation will be given to subjects. Emergency First Aid and assistance is provided by registered members of the National Ski Patrol. This service is provided free of charge.
Although every precaution is taken to ensure accuracy, errors or misunderstandings in price, quantity, and/or specifications may occur. We reserve the right to correct such errors.
I consent to and authorize the taking of photographs and/or videos during my and/or the minor's visit to Crystal Mountain. I grant permission to Crystal Mountain Resort to use said photographs and/or videos in advertising, displays, web sites, brochures, other forms of electronic and social media, illustrations or publications without notifying me. I hereby waive any and all rights to privacy in the photographs/videos and to compensation related to the use of the photographs and or videos.
I recognize that situations may arise where emergency or emergent medical or dental care may be necessary for me and/or a Minor. I authorize Crystal Mountain Resort to render first aid and to call for medical and/or dental care if, in their opinion, such medical or dental care is needed. I agree to pay for all expenses and costs associated with such care and related transportation. I understand these Terms & Conditions shall be binding upon my assignees, subrogees, distributes, heirs, next of kin, executors, personal representatives and administrators and may be pled by Crystal Mountain Resort as a complete bar and defense against any and all claims, demands, or causes of action by or my behalf. Any provision of these Terms & Conditions which shall prove to be invalid, void or illegal in no way affects, impairs or invalidates any other provision hereof, and such other provisions shall remain in full force and effect. I acknowledge that this activity is taking place in the State of Michigan, and I further agree that only the laws of the State of Michigan shall apply in the construction or application of these Terms & Conditions.
